Terms of Service

These Terms of Service (“Terms”) govern your use of BabyMeld, including the BabyMeld Android application, website, AI image-generation features, and related services (collectively, the “Service”).

The Service is operated by Globid Inc. (“Globid,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old, or the minimum age required in your country to use the Service.

If you are under the age of legal majority where you live, you may use the Service only with the permission of a parent or legal guardian where required by law.

2. About BabyMeld

BabyMeld is an entertainment application that uses artificial intelligence to create hypothetical images of what a child inspired by the visible characteristics of two people might look like.

The Service may offer features including:

• AI-generated child portraits;
• boy or girl variations;
• different age variations;
• regenerated or alternative images;
• saving and sharing generated images;
• additional AI features introduced in the future.

Features may differ between free and paid versions of the Service.

3. Entertainment Only — No Genetic Prediction

BabyMeld does not perform genetic analysis.

Generated images:

• are created by artificial intelligence;
• are hypothetical;
• are for entertainment purposes;
• do not predict how an actual child will look;
• are not medically, scientifically, or genetically accurate predictions.

The Service must not be relied upon for medical, reproductive, genetic, scientific, legal, or other professional decisions.

4. User Content

“User Content” includes photographs, images, prompts, instructions, messages, and other material you submit to the Service.

You represent and warrant that:

• you own the User Content or have the necessary rights and authorization to use it;
• you have the right to provide photographs of the people depicted;
• your use of the content does not violate another person's privacy, intellectual-property, publicity, or other legal rights;
• the content is not unlawful.

Do not upload another person's photograph without appropriate authorization. You remain responsible for the content you submit.

5. License Necessary to Provide the Service

You grant us a limited, non-exclusive license to process, transmit, resize, reproduce, and otherwise technically use User Content only as reasonably necessary to:

• operate the Service;
• transmit content to AI infrastructure providers;
• generate the requested result;
• provide technical support;
• prevent abuse;
• comply with applicable law.

This license does not give us the right to sell your photographs.

6. AI Service Providers

The Service relies on third-party artificial-intelligence and infrastructure providers. These providers may receive and process User Content in order to produce requested results.

AI systems can produce unexpected, inaccurate, inconsistent, offensive, unrealistic, or otherwise undesirable results.

We do not guarantee:

• a particular degree of resemblance;
• a specific appearance;
• genetic accuracy;
• scientific accuracy;
• that every generation will be successful;
• that two generations will produce similar results.

7. Generated Content

Subject to applicable law and third-party provider terms, you may save, share, and use images generated for you through the Service for lawful purposes.

We do not claim ownership of your original uploaded photographs.

Rights in AI-generated material can vary depending on applicable law and jurisdiction.

You are responsible for ensuring that your use of generated content complies with applicable law and does not infringe another person's rights.

8. Prohibited Uses

You may not use the Service to:

• violate any law or regulation;
• infringe intellectual-property, privacy, publicity, or other rights;
• impersonate another person deceptively;
• harass, threaten, defame, exploit, or harm another person;
• create or distribute illegal content;
• bypass subscription, payment, advertising, security, or usage restrictions;
• interfere with or attack the Service or its infrastructure;
• reverse engineer or abuse the Service except where applicable law expressly permits it;
• access the Service through unauthorized automated means;
• use the Service for unlawful surveillance or identification;
• upload images that you do not have the right to use.

Child Safety

The Service may never be used to create, upload, request, distribute, promote, or facilitate:

• child sexual abuse material;
• sexualized content involving minors;
• sexual exploitation of children;
• grooming or solicitation of minors;
• trafficking or exploitation of children;
• any other child sexual abuse or exploitation.

We may immediately restrict access and report conduct to appropriate authorities where required by law.

9. Free Features

We may offer limited free functionality. For example, a user may receive a limited number of free AI generations.

Free limits may:

• vary by version;
• vary by region;
• change over time;
• be subject to advertising;
• be restricted to specific generation options.

We may modify or discontinue free functionality at any time, subject to applicable law.

Attempts to circumvent free-use restrictions may result in access being limited or blocked.

10. Premium Subscriptions

BabyMeld may offer automatically renewing subscriptions through Google Play.

Available plans, pricing, billing periods, introductory offers, and other purchase terms are displayed in the application and in the Google Play purchase interface before you confirm a purchase.

Prices may vary by:

• country;
• currency;
• taxes;
• platform;
• promotional offer.

The price displayed by Google Play at the time of purchase controls.

11. Automatic Renewal and Cancellation

Unless otherwise stated in the purchase interface, subscriptions may automatically renew at the end of each billing period until canceled.

Android subscriptions purchased through Google Play can be managed or canceled through the user's Google Play subscription settings.

Canceling a subscription generally prevents future renewal but does not necessarily terminate access immediately. Access may continue for the remaining paid subscription period.

Deleting BabyMeld from your device does not automatically cancel an active subscription.

12. Refunds

Purchases made through Google Play are subject to:

• applicable law;
• Google Play billing and refund rules;
• any refund rights we are legally required to provide.

Where permitted, refund requests may need to be submitted through Google Play or through the applicable purchase platform.

Nothing in these Terms limits mandatory consumer refund rights that cannot legally be waived.

13. Advertising

The free version of BabyMeld may contain third-party advertising.

Premium plans may provide an ad-free experience where stated in the application.

Advertising availability, frequency, and format may change.

14. Service Availability

AI generation depends on internet access and third-party infrastructure.

The Service may occasionally be:

• unavailable;
• delayed;
• interrupted;
• subject to rate limits;
• affected by provider outages;
• unable to generate certain requested content.

Generation time may vary. We do not guarantee uninterrupted or error-free operation.

15. Changes to Features

We may add, remove, modify, or discontinue features.

We may also change:

• AI providers;
• AI models;
• generation settings;
• free-use limits;
• subscription features;
• advertising implementation;
• supported devices.

Where required by applicable law, material changes affecting paid services will be handled accordingly.

16. Intellectual Property

The Service, including its:

• software;
• interface;
• branding;
• design;
• graphics;
• text;
• logos;
• underlying technology;

is owned by Globid Inc. or its licensors and is protected by applicable intellectual-property laws.

These Terms do not grant you ownership of the Service.

17. Feedback

If you voluntarily provide suggestions or feedback about BabyMeld, you permit us to use that feedback to improve the Service without obligation to compensate you.

This does not transfer ownership of your private photographs or other User Content.

18. Suspension and Termination

We may suspend or restrict access to the Service if reasonably necessary because of:

• violation of these Terms;
• fraud;
• payment abuse;
• security threats;
• unlawful activity;
• abuse of AI infrastructure;
• threats to other users or the Service.

You may stop using the Service at any time.

Stopping use or uninstalling the application does not automatically cancel a subscription.

19. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis.

We do not guarantee that:

• AI results will meet your expectations;
• generated children will resemble an actual future child;
• generated images will be accurate;
• the Service will always be available;
• every generation will complete successfully;
• AI outputs will be free of errors or artifacts.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

20. Limitation of Liability

To the maximum extent permitted by applicable law, Globid Inc. will not be liable for indirect, incidental, special, consequential, exemplary, or similar damages arising from use of or inability to use the Service.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms limits liability where limitation is prohibited by law.

21. Third-Party Services

The Service may depend on third parties, including:

• Google Play;
• Google AdMob;
• Google Firebase;
• Vercel;
• AI model and infrastructure providers;
• operating-system and device providers.

We are not responsible for third-party services outside our reasonable control.

Your use of third-party services may also be governed by their own terms and policies.

22. Privacy

Our Privacy Policy explains how information is processed in connection with the Service.

By using BabyMeld, you should review the Privacy Policy together with these Terms.

23. Governing Law

These Terms are governed by the laws applicable in Québec, Canada, without limiting any mandatory consumer-protection rights that apply to you based on your place of residence.

If applicable consumer law gives you rights that conflict with these Terms, those mandatory legal rights prevail.

24. Changes to These Terms

We may update these Terms from time to time.

The updated version will display a revised “Last updated” date.

Where required by law, we will provide additional notice before material changes take effect.

Continued use of the Service after updated Terms become effective constitutes acceptance to the extent permitted by applicable law.
